Terms of Service

1. Agreement to Terms

By creating an account on Fluency ("the Platform"), operated by Sondera Studios ("we", "us", "our"), you ("the Assessor", "you") agree to be bound by these Terms of Service. If you do not agree, do not create an account.

2. Description of Service

Fluency is a B2B SaaS platform that enables hiring organisations to assess candidates' AI literacy through structured tasks. The Platform provides candidate invitation management, AI-powered assessment delivery, automated scoring, and candidate reports.

3. Account Responsibilities

  • You must provide accurate information when creating your account.
  • You are responsible for maintaining the security of your account credentials.
  • You must notify us immediately of any unauthorised access to your account.
  • You are responsible for all activity that occurs under your account.
  • You must have the authority to act on behalf of the organisation you register.

4. Acceptable Use

You agree not to:

  • Use the Platform for any purpose other than assessing candidates in a legitimate hiring process.
  • Share candidate assessment results with parties not involved in the hiring decision.
  • Attempt to reverse-engineer, decompile, or extract the scoring algorithms.
  • Use the Platform to discriminate against candidates on any protected characteristic.
  • Submit false or misleading information about candidates or your organisation.
  • Attempt to interfere with the Platform's operation or security.

5. Candidate Data & GDPR

When you invite candidates to an assessment, you act as the data controller and Sondera Studios acts as the data processor under GDPR. You are responsible for having a lawful basis to share candidate personal data with us (e.g. legitimate interest in the hiring process). A Data Processing Agreement (DPA) is available on request — contact legal@sonderastudios.com.

6. Intellectual Property

  • The Platform, including its design, scoring engine, and assessment content, is owned by Sondera Studios.
  • Assessment reports generated for your organisation are licensed for your internal hiring use only.
  • Candidate responses remain the intellectual property of the candidate. You may use them only for the purpose of evaluating the candidate's suitability for the role.

7. AI-Generated Scores

Assessment scores are generated by AI and are provided as a decision-support tool, not a definitive judgement. Scores should be considered alongside interviews, references, and other assessment methods. Sondera Studios does not guarantee the accuracy of AI-generated scores and is not liable for hiring decisions made based on them.

8. Limitation of Liability

To the maximum extent permitted by law, Sondera Studios shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to loss of data, revenue, or business opportunities.

9. Termination

Either party may terminate this agreement at any time. Upon termination, your access to the Platform will be revoked. Assessment data will be retained for 12 months after termination (see our Privacy Policy), after which it will be permanently deleted.

10. Changes to Terms

We may update these Terms from time to time. We will notify registered assessors of material changes via email at least 30 days before they take effect. Continued use of the Platform after changes constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
